Terms and Conditions
DEFINITIONS
In these Conditions:
‘Membership’ means your paid for membership to the Nova Cinema including a login to the Website which provides Benefits to the holder.
‘Acceptance’ ‘Accepted’ ‘Accepting’ means confirmation by Nova verbally or in writing (including by email) that Your Membership application has been accepted and Your Benefits will commence.
'Benefits' means those benefits and discounts at Nova Cinema and from external providers which are from time to time notified on our Website, newsletters or mailings, as available to holders of a valid and current Membership. Additional terms and conditions may apply to individual Benefits and discounts.
‘Validity Period’ means 12 months from the date of purchase and any subsequent renewal date.
1. BENEFITS
All Benefits are subject to availability and to these Conditions. A valid Nova Membership will entitle You to the Benefits but You acknowledge that some or all of the Benefits may be added to, removed or altered by Nova Cinema at its discretion.
Your Benefits include:
- 5 free film tickets per year, provided in the form of five vouchers equivalent to the price of one full price peak ticket each;
- Tickets priced at the off-peak rate, valid for all films screening Monday - Thursday and before 6.30pm on Friday, for you and one guest.
- after You use your 5 free film ticket vouchers per year, You will receive a 10% discount on full price adult tickets (including screen 7 tickets) You purchase for You and one guest;
- 10% discount on screen hires; and
- 10% discount on purchases of food and beverages (excluding alcoholic beverages).
Off-peak day tickets and 10% discounts under the Benefits cannot be used on Nova Live tickets.
Off-peak day tickets and 10% discounts cannot be used in conjunction with any other offer.
Free tickets and off-peak day tickets can be used on Screen 7 screenings.
10% food and beverage discount only applicable when items are bought at the cinema kiosk. It cannot currently be used via At Seat Service.
2. PURCHASING A MEMBERSHIP
When Your application for a Membership has been Accepted a contract in accordance with these Conditions has been formed between both of us and You will be issued with a Membership number.
To purchase a Membership you must be over the age of 18 and be a UK resident.
The Benefits can be utilised immediately upon Acceptance and You will be issued with Your Membership login immediately. Your Membership login must be used (You must be logged in to our Website) or quoted at all times when claiming Benefits.
Subject to these Conditions, Your Membership will be valid for the Validity Period.
You authorise us to take the annual subscription amount automatically using either your payment card (a ‘recurring card payment’) or Direct Debit (if available).
If a payment fails, we may re-attempt within a reasonable time and/or suspend access until a new payment is received.
3. USING YOUR MEMBERSHIP
Your Membership is a personal revocable licence and is, at all times, the property of Nova Cinema. Nova reserves the right to refuse to supply You with a Membership and can terminate Your Membership at any time if, in its reasonable opinion, You are in breach of these Conditions.
These Conditions include, but are not limited to, providing false information at the time of Acceptance, misuse of Your Membership in anyway or irregularity in the use of Your Membership.
Your Membership is strictly non-transferable to any third parties. Only the named holder on the Membership will be entitled to use the Membership and to receive Benefits.
Any Benefits and tickets obtained in breach of these Conditions will be made null and void and Nova Cinema may refuse to admit the ticket holders to the venue.
4. YOUR MEMBERSHIP RENEWAL
Your membership runs for 12 months and auto-renews for further 12-month periods unless you cancel.
We will send two renewal reminders:
(1) at least 30 days before the renewal date; and
(2) a further reminder at least 14 Working Days before the last date to cancel without charge. Each reminder will state the renewal date, amount, any price change since last year, the dates of your cooling-off period and how to cancel.
If we change the price or materially change the Membership, we’ll give at least 30 days’ prior notice by email. If you do not agree, you may cancel before the change takes effect; otherwise the new price or Membership applies at your next renewal.
If you pay by Direct Debit (where available), your payments are covered by the Direct Debit Guarantee and you will receive advance notice of changes in amount, date and frequency under the scheme rules.
If You do not cancel Your Membership it will automatically renew on the day following the last day of the Validity Period, and a new payment will be taken from the payment method you authorise us to use.
5. CANCELLING YOUR MEMBERSHIP
You have the right to cancel Your Membership at any time. Unless a statutory cooling-off period applies, cancellation takes effect at the end of the current 12-month period and no pro-rata refund will be given for the remainder of the Validity Period. You can cancel by logging in to your account on our Website or by contacting our Membership team on help@novacinema.com.
If you have paid by recurring card payment, you may cancel the recurring card authorisation by telling us, or by instructing your card issuer. Your card issuer will stop any future payments. Cancelling a payment authority does not, by itself, cancel your contract; please also cancel the Membership with us by emailing help@novacinema.com
We will acknowledge in writing (by email) and confirm the date your Membership contract ends. If you cancel online, we will send an end-of-contract notice within 24 hours.
You may cancel during the 14-day period from the day you purchased your Membership (‘cooling-off period’).
You may cancel during the 14-day period from the day after your Membership auto-renews, or if any free or discounted trial (if available) renews into a paid plan.
We will send you a renewal cooling-off notice on day 1 of that period, by email, including details of how to cancel.
6. AFTER CARE & COMPLAINTS
Should You have any queries or issues relating to Your Membership purchase please contact our Membership team via help@novacinema.com. We will acknowledge all customer correspondence within 24 hours and We shall respond more fully within 5 Working Days.
7. DATA PROTECTION
You must ensure that the information provided by You when You Accepted Your Membership is accurate and complete and contains Your correct name, contact address, telephone number and/or email address and any other requested details.
lt is Your responsibility to inform Nova of any personal detail changes.
Nova Cinema will use this personal information to provide You with all information connected with the supply of Your Membership including Benefits, renewals, brochures and newsletters, events, offers and changes to the Membership scheme. By Accepting a Membership You consent to Your information being used in this way.
Please note that if You refuse or withdraw certain contact permissions, we may not be able to provide You with all the services that Your Membership entitles you to.
